Tree Rights?

We have a neighbour who is complaining about our tree height. The leylandii trees are in the centre of our garden, aprox. 20ft tall. He complains they block his light even though we cut several metres from them and they have been that tall for about 20yrs. They block my bedroom from view. The trees by our fence he complains also need removing or cutting. The fence is not adjoining his property, but a public road, which seperates his property and our back fence. What are our rights?

Hi,i had the same problem in my previous house,if the trees are not blocking his light out,and as you say not overhanging onto his property,there is,nt a thing he can do about it,the only time he could do something about it,is if he has been living there for 20yrs and the trees were blocking his light out,then they would have to be cut down a lot.but as they,re not you can only but ignore him,he sounds like one of those neighbours that wants something to complain about,you do get them.anyway you can always go to citizens advice,you,ll find they will tell you the same.
Reply:if the trees are on your prop. and in no danger of falling on his prop. there is nothing he can do. enjoy your trees.
Reply:You own the property, which means that you own the tree. That also means that your neighbor cannot tell you what to do. He can ask, and you can tell him that you like the trees the way they are. And there is nothing that he can do about it. If he really wanted to be a butt.. he could try and take you to court. But you would win the case. The only way that you would loose the case is if He owns the property that you are living on, and he is still asking more of you.

If the tree is blocking your bedroom window, and he still is wanting you to cut it down when you tell him that he wants it down, then I think you have a Perv on your hands.

Reply:Its your responsibilty to sort them, imagine if your neighbour had trees that blocked your light and you wanted them sorted but they wouldnt. Neighbours trees are a nightmare, we have the same problem and they wont bother cutting them back. Whats the big deal they grow again anyway??????
Reply:Leylandi trees have been a pain for many years and I believe that the govt passed new laws./rules regarding these.

However if they have been there over 20 yrs I dont think you have a problem. If they block your view from the bedroom maybe thats what you want but cut the buggas down and get some net curtains.

Re the trees overhanging well it suprises me that the council have not trimmed em for you and sent you the bill.

Trim em back and enjoy the light you may enjoy it and also they will look great if you do them correctly.



PS Re the rules governing trees check with you local council they will help.
Reply:Simple answer. If the trees are on your property there is nowt he can do.

Personally i would reduce the trees. They do seem to be rather large.

Just noticed your additional details. Well they are kept trim so tell your neighbour to stop moaning. I was picturing scruffy laylandii.
